Do You Need a Buyer's Agent in Florida? (2026)
By Tamily Abdo, REALTOR® · Best of Tampa Bay Now · 2026-08-17

The way buyers work with agents changed in 2024, and there's still confusion about it. Here's a clear explanation of buyer representation in Florida today. (General information, not legal advice.)
What changed in 2024
Following a national settlement, two big things are now standard: buyers sign a written buyer-representation agreement before touring homes with an agent, and buyer-agent compensation is negotiable and no longer advertised in the MLS. In short, how your agent gets paid is now an explicit conversation up front.
What a buyer's agent actually does
- Finds and evaluates homes against your needs and budget.
- Runs comparable sales so you don't overpay.
- Writes and negotiates your offer, including seller concessions.
- Coordinates inspections, timelines, and closing.
- Represents your interests — especially important on new construction, where the on-site rep works for the builder.
How your agent gets paid now
Compensation is negotiable. It might be paid by the seller as a concession, by you directly, or a combination — and it's spelled out in your agreement before you start. Ask your agent to explain the options clearly.

Do you need one?
You're not legally required to have one, but a good buyer's agent brings market knowledge, negotiating leverage, and process management to one of the biggest purchases of your life — at terms you agree to in advance.
The bottom line
The 2024 changes made representation more transparent, not less valuable. Understand the agreement, negotiate the terms, and choose an agent you trust.
